By visiting duartefence.com, submitting a contact or estimate request, or engaging Precision Duarte Fence("we," "us," or "our") for any service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services. We reserve the right to update these terms at any time. Continued use of our website or services following any update constitutes acceptance of the revised terms.
Precision Duarte Fence provides residential and commercial fence installation, repair, replacement, and related services in Duarte, CA and surrounding communities. Services are provided pursuant to a written proposal or contract signed by both parties. The scope, materials, timeline, and price for each project are defined in the written agreement provided to you before work begins. Any changes to the agreed scope must be made in writing and signed by an authorized representative of Precision Duarte Fence.
Estimates provided by Precision Duarte Fence are based on information available at the time of the on-site visit and are valid for 30 days from the date issued unless otherwise noted. An estimate is not a contract. Work will not begin until a written agreement is signed and any required deposit is received.
Final pricing may differ from an estimate if unforeseen site conditions are discovered after work begins, including but not limited to: underground obstructions, soil conditions that require additional materials or labor, changes to local permit requirements, or changes to the scope requested by the customer. We will notify you of any material cost changes before proceeding with additional work and will obtain your written or verbal approval before incurring additional charges.
Where required by local ordinance, Precision Duarte Fence will obtain applicable building permits on your behalf as part of the project. Permit fees are charged to the customer at cost. You are responsible for providing accurate information about your property, including boundaries, HOA rules, and any deed restrictions. Precision Duarte Fence is not liable for permit delays caused by incomplete or inaccurate information provided by the customer, HOA review delays, or city processing backlogs.
Once a project is scheduled, we will provide you with an estimated start date. Schedules are subject to change due to weather, permit delays, material availability, or other factors outside our control. We will notify you as soon as possible if your start date needs to change.
If you need to cancel or reschedule, please notify us as early as possible. Cancellations made after materials have been ordered or fabricated may result in restocking fees or material costs being charged to the customer. Deposits are non-refundable once materials have been ordered, unless Precision Duarte Fence is unable to perform the work through no fault of the customer.
Payment terms are stated in your written project agreement. In general:
Invoices not paid within 30 days of the due date may be subject to a late payment fee as permitted by California law. Precision Duarte Fence reserves the right to pursue collection of unpaid balances, including reasonable attorney fees and court costs if legal action is required.
You agree to:
Precision Duarte Fence warrants that all workmanship will be performed in a professional manner and free from defects in labor for a period of one year from the date of project completion, unless a different warranty period is stated in your written agreement. This workmanship warranty covers defects in installation - such as posts that fail to remain plumb, rails that separate from posts, or panels that detach under normal conditions.
Materials are covered by the manufacturer or supplier warranty applicable to those materials, if any. We will assist you in pursuing a manufacturer warranty claim where applicable.
Warranty coverage does not apply to damage caused by: severe weather events (including but not limited to high winds, flooding, or earthquakes), vehicle impact, vandalism, improper use, modifications made by others after project completion, or normal wear and weathering of natural materials such as wood.
To the maximum extent permitted by California law, Precision Duarte Fence's total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific project giving rise to the claim.
Precision Duarte Fence shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of use, loss of revenue, or damage to property not directly caused by our work. Some states do not allow the exclusion of certain damages, so these limitations may not apply to you in full.
Except for the express workmanship warranty described above, Precision Duarte Fence provides services "as is" and makes no additional warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, beyond what is required by applicable law. Information on our website is provided for general informational purposes only and does not constitute a representation or warranty about any specific project.
If a dispute arises between you and Precision Duarte Fence, we ask that you first contact us directly to try to resolve it. Most concerns can be addressed quickly with a phone call or email. Please reach out to us at sales@duartefence.com or (626) 659-1641.
If we are unable to resolve the dispute informally, both parties agree to attempt mediation before pursuing litigation. Any legal action arising from these terms or our services shall be brought in the appropriate court located in Los Angeles County, California.
These Terms and Conditions and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Precision Duarte Fence reserves the right to modify these Terms and Conditions at any time. Changes take effect when posted to duartefence.com with an updated effective date. We encourage you to review these terms periodically. Your continued use of our website or services after a change is posted constitutes your acceptance of the updated terms.
